Jens T. Theilen studied law at Bucerius Law School, Hamburg, and at the University of Oxford. They have held positions as a research and teaching associate at Bucerius Law School and at the Walther Schücking Institute for International Law, University of Kiel, and served as the assistant editor of the Friedens-Warte (Journal of International Peace and Organisation). Jens is currently responsible for coordinating the project on “new” human rights at the Walther Schücking Institute, in cooperation with the Danish Institute for Human Rights and the Law School of Tallinn University.
Jens’s research interests lie in the field of human rights, spanning comparative constitutional law as well as European and international law. The main focus is human rights theory, and their doctoral thesis deals with the “European consensus” argument as used by the European Court of Human Rights, investigating its normative force from the perspective of regional human rights theory. Jens also has a particular interest in minority rights, especially transgender and intersex rights, and the intersection between queer theory and legal studies. A further recurring theme in their research is the relationship between law and time, particularly the role of legitimate expectations in assessing the validity of retroactive legal acts and the theoretical implications of judgments’ temporal effects. They have published on these fields, for example, in the Human Rights Law Review, the German Yearbook of International Law, and the European Law Review.
